Programming notice for Alamogordo, Ruidoso and Cortez

Effective Friday, April 22, 2022, TDS will no longer carry KVIA-ABC (El Paso) in Alamogordo, Ruidoso, Holloman Air Force Base, La Luz, Capitan, and Tularosa, New Mexico. 

KVIA is the ABC station licensed in the El Paso Designated Market Area (DMA) and is considered an out-of-market station for these TDS communities, which are located in the Albuquerque DMA.  TDS received notice from the Albuquerque-licensed station that prohibits TDS from distributing ABC network programming aired on KVIA. Under FCC regulation, TDS must comply this request.

ABC will still be broadcast in the area on Channel 7 (KOAT).

KVIA is on Channel 6/106 for our TDS TV customers and on Channel 10 for our TDS TV+ customers. Customers can stream live news from KVIA here.

KUSA is the NBC station licensed in the Denver Designated Market Area (DMA) and is considered an out-of-market station for Cortez, which is located in the Albuquerque DMA.  TDS received notice from the Albuquerque-licensed station that prohibits TDS from distributing NBC network programming aired on KUSA. Under FCC regulation, TDS must comply this request.

KUSA NBC is on Channel 10 on our legacy Cable and TDS TV+ platforms. For our TDS TV+ customers, KUSA Cozi is on Channel 11, KUSA True Crime is on Channel 12, and KUSA Quest is on Channel 15.

Why can TDS no longer offer these stations?

These stations are licensed to serve a different television market, which means it is considered out of your local broadcast area. You had been receiving these stations as part of a business agreement with the station’s owner. However, TDS has recently received television programming ‘non-duplication notices’ form each of the NBC (KUSA) and ABC (KVIA) broadcast station owners that operate within the television market. As a result, TDS can no longer offer KVIA and KUSA programming out of market in order to remain in compliance with the notices received.

What makes a broadcaster or station out-of-market?

Any broadcaster that’s located in, and broadcasts from, a different television market than the one you live in is considered an “out-of-market” broadcaster. This means that in addition to the stations you receive from within your primary television market, “in-market”, you may also receive stations from out-of-market broadcasters who happen to have signals that reach your area.

What is a television market and who determines the boundaries?

Television markets are also known as Designated Market Areas (DMAs) and are not limited by state lines or other geographic boundaries.

A DMA is a geographic area that represents specific television markets as defined by and updated annually by the A.C. Nielsen Company. All municipalities are assigned to a primary DMA. Accordingly, customers receive broadcast channels based on the municipality in which they live. TDS does not control the designation of DMAs nor determine where municipalities are assigned.
